Terms and conditions
These terms have two parts. Part A governs the use of Parkoni between you and us, Cryon UG (haftungsbeschränkt). Part B contains the terms of the parking contract that you conclude with the operator of the car park you book; all operators on Parkoni have agreed to them.
Part A: Using Parkoni
A 1 Who we are
Parkoni (parkoni.com) is operated by Cryon UG (haftungsbeschränkt), Landsberger Str. 35, 04157 Leipzig, Germany, email support@parkoni.com (further details in the Legal notice). These terms apply to everyone who uses Parkoni to search for, compare and book car parks.
A 2 Parkoni is a marketplace
(1) On Parkoni, independent operators offer their car parks at airports and ports. We arrange these offers. You conclude the parking contract with the operator, not with us; you can see who the operator is on the offer page, before you submit your booking and in your booking confirmation.
(2) All operators on Parkoni have declared to us that they act as traders and have given us proof of their business activity. The rights that consumers have against traders therefore apply to your parking contract.
(3) The operator alone is responsible for the parking service (space, transfer, vehicle handover, booked extras). We are responsible for the platform, the correct presentation of the booking process, the transmission of your booking and the payment processing that we carry out on behalf of the operator. Please direct questions and claims under the parking contract to the operator directly first; its contact details are in every booking email, on your voucher and on your booking page. We are responsible for questions about payment and your account. If you turn to us with a concern about the parking contract, we pass it on to the operator without delay. We receive declarations on the parking contract that you address to us (for example a cancellation or a notice of a defect) as the operator's agent for receipt; they are deemed to have reached the operator when they reach us.
(4) We are not a tour operator and do not arrange package travel.
A 3 Costs
Using Parkoni is free of charge for travellers. We charge no booking or service fee. The total price shown is the operator's final price for the chosen parking period; VAT is included where the operator charges it. The operator pays us a commission for the arrangement. It is not added to the price and does not affect the order of the search results.
A 4 Search and order
(1) By default, we order the search results according to a published formula. The main parameters are the total price, the transfer time to the terminal, the flexibility of cancellation, instant confirmation and the operator's cancellation rate. We explain how the parameters are weighted on the page How the order is made. You can also sort and filter the results by price or distance.
(2) Car parks that cannot yet be booked on Parkoni are shown in grey and without a price. If you choose "I want to book here" there, we count this without any link to you personally, to show the operator that there is demand.
A 5 Booking and conclusion of the contract
(1) The offers on Parkoni are not yet binding offers by the operators. You choose an offer and the period, enter your details and the details of your vehicle, choose extras and the payment method and then see a summary with all the information, the total price and the cancellation conditions. Until then you can check every entry and correct it in the previous steps.
(2) By clicking "Order with obligation to pay", you submit a binding offer to conclude the parking contract with the operator. For offers with instant confirmation, the contract is concluded as soon as we display the booking confirmation to you on behalf of the operator and send it by email; for online payment, this requires that the payment has succeeded.
(3) For offers on request, the operator decides within the period shown, but at the latest within 48 hours after your booking; after that you are no longer bound by your offer. Until then your card is only pre-authorised (reserved), not charged. If the operator accepts, the contract is concluded with our confirmation and the amount is charged; if it declines or does not decide in time, the pre-authorisation is released.
(4) The confirmation contains your voucher with all the arrival details. We store the contract text; you can find it at any time in the confirmation email, on your voucher and through the link to manage your booking. The contract language is the language in which you booked.
A 6 Prices and payment
(1) All prices are final prices; VAT is included where the operator charges it. All prices and payments are in euros. If you read Parkoni in a language outside the euro area or from a country without the euro, we show the approximate amount in your currency in brackets; it is for orientation only, the euro amount is charged. If you pay with a card in another currency, your bank converts the amount and may charge a fee for this; we have no influence on that.
(2) You pay online by card, Apple Pay or Google Pay through the payment service Stripe. Your payment goes directly to the operator; with it, your obligation under the parking contract is fulfilled. Neither we nor the operator receive card data. If the operator offers payment on site, you pay there, at the latest when your vehicle is handed back.
(3) No additional fees are charged for payments. You receive receipts and invoices on behalf of the operator by email and through your booking.
A 7 Changing and cancelling
(1) Through the link in your confirmation you can manage your booking: change the registration number and flight details, call up the voucher again and cancel. A change of the period is made as a new booking followed by cancellation of the old booking; beforehand you see which amount will be refunded.
(2) The operator's cancellation conditions apply to cancellations; they were shown before the booking and are stated in your confirmation. Refunds go to the original means of payment, usually within 5 to 10 working days after the cancellation.
(3) Whether you have a statutory right of withdrawal is explained under Withdrawal.
A 8 Customer account
You can book without an account. With an account you see all your bookings in one place; you log in with your email address and a password; if you forget your password, you reset it through a link that we send to your email address. Keep your password and access to your mailbox protected. You can have your account deleted at any time (see Privacy).
A 9 Your obligations
Please give correct and complete details when booking, in particular your email address, telephone number and registration number. You must not misuse Parkoni, in particular you must not make sham bookings, run automated queries on a large scale or circumvent the security measures of the platform.
A 10 Reporting unlawful content
(1) If you find content on Parkoni that you consider unlawful (for example a misleading or fraudulent offer or photos that infringe third-party rights), please report it to us by email at support@parkoni.com. The report should contain: a reason why the content is unlawful, the exact address (URL) of the page, your name and email address, and a statement that your information is correct and complete to the best of your knowledge.
(2) We confirm receipt, examine the report promptly, carefully and objectively, and tell you our decision with reasons and with information on your remedies (complaint to support@parkoni.com, recourse to the courts). If we restrict content or an offer, the operator concerned receives a statement of reasons with the facts, the legal basis, a note on whether automated means were used, and the remedies (internal complaint procedure under § 22 of the partner contract, courts), and can comment on it.
(3) If someone repeatedly submits manifestly unfounded reports, we may, after a prior warning, stop processing their reports for a reasonable time.
A 11 Content and moderation
(1) The operators provide the information about the car parks; we have prepared some information from the operators' public sources. We check new car parks before they go live, check changes to name, address, type of transfer and photos afterwards, and correct, block or remove content that is false, misleading or unlawful or that breaches the partner contract.
(2) For moderation we do not use automated decisions on content; a human makes the decisions. Only the order of the search results (A 4) and technical protection against misuse, such as limits on the number of requests, work automatically.
A 12 Our liability
(1) We are liable without limitation for damage resulting from injury to life, body or health, for intent and gross negligence, under the Produkthaftungsgesetz (German Product Liability Act) and to the extent of a guarantee given.
(2) In cases of slight negligence, we are liable only for the breach of essential obligations, the fulfilment of which makes the proper use of Parkoni possible in the first place and on which you can regularly rely (for example the correct transmission of your booking), and limited to the foreseeable, typical damage.
(3) The operator is liable for the provision of the parking service under Part B; we are not liable for it unless we are ourselves at fault for a breach of duty under paragraph 1 or 2.
(4) We endeavour to keep Parkoni available at all times but cannot guarantee it, for example during maintenance or in the event of disruptions for which we are not responsible.
A 13 Applicable law and jurisdiction
(1) German law applies to these terms. If you are a consumer, the protection afforded by the mandatory provisions of the country in which you have your habitual residence remains unaffected.
(2) As a consumer, you can sue us in Germany or in the country where you live. If you are not acting as a consumer but in the exercise of your trade or self-employed activity, the place of jurisdiction is Leipzig.
(3) Information on dispute resolution can be found under Complaints and dispute resolution.
A 14 Language and changes
(1) These terms are available in all languages of Parkoni. The version in the language in which you booked prevails.
(2) The terms in the version that applied when you booked apply to your booking. If we change these terms, the new versions apply only to later bookings. For your customer account, we notify changes by email at least 30 days beforehand. The changed terms apply to the account only if you agree to them; if you do not agree, we can terminate the account with 30 days' notice, and you can have it deleted at any time.
Part B: Terms of the parking contract
B 1 Scope
(1) These terms apply to the parking contract between you and the operator that you booked through Parkoni. The contract also includes the description of the offer, the cancellation conditions and the arrival instructions that were shown before the booking and are stated in your confirmation.
(2) If the operator's offer provides terms that are more favourable to you, those apply. The law of the country in which the car park is located applies to the parking contract. If you, as a consumer, have your habitual residence in another country, you keep the protection afforded by its mandatory provisions, to the extent that they also apply under the law despite this choice of law.
B 2 Service
(1) The operator provides a space for your vehicle for the booked period on the stated premises and provides the booked transfer (shuttle to and from the terminal, vehicle handover at the terminal or walking route, as described in the offer) and the booked extras.
(2) If you hand your vehicle or key to the operator (for example with valet parking or key handover), the operator takes custody of the vehicle and key and keeps them safe with due care. It may park the vehicle only on the stated premises and move it only as far as necessary for the service.
(3) A specific space is not owed unless the offer provides for one.
B 3 Arrival and handover
(1) Please arrive within the booked period and follow the arrival instructions. Show your voucher (on your smartphone or printed). The registration number must match the booking; change it beforehand through the booking management.
(2) If you arrive later than booked, the operator keeps your space free until the end of the day of arrival, unless the arrival instructions say otherwise. Earlier arrival is possible only subject to availability and may cost a surcharge for additional time at the booked rate.
(3) At handover, you and the operator can record the condition of the vehicle together, for example with photos and the mileage. We recommend this.
B 4 Return and collection
(1) After landing or once your ship is in, report as described in the arrival instructions. If you gave your return flight number, the operator takes a delay into account as far as it can detect it.
(2) If your stay is longer than booked, the operator charges the additional days at the rate that was shown for extension days when you booked. You pay this amount on collection, unless agreed otherwise.
(3) Check your vehicle on return. Please report visible damage immediately on site so that it can be recorded. Report damage discovered later to the operator without delay; your statutory rights remain unaffected.
B 5 Your vehicle
(1) Your vehicle must be registered, insured and roadworthy and must match the booked vehicle type and size. There must be no hazardous substances and no animals in the vehicle.
(2) If a vehicle does not match the booking and the operator cannot therefore accept it, the operator offers you a suitable alternative where possible. If it cannot do so and you gave false information about the vehicle when booking, intentionally or through gross negligence, the cancellation conditions for a cancellation on the day of arrival under B 6 (1) apply, even if the booked arrival time has already passed.
(3) Please do not leave any valuables or documents in the vehicle.
B 6 Cancellation by you and no-show
(1) You can cancel until the booked arrival time. The amount refunded depends on the cancellation conditions of the offer.
(2) If you do not show up and do not cancel, the share that the cancellation conditions provide for a no-show applies. If you pay on site, you pay nothing in this case, unless the cancellation conditions provide otherwise.
(3) If the operator keeps part of the price under the cancellation conditions, it must credit expenses saved and any other use of the space. The amount retained must not exceed the loss that the operator can expect in the ordinary course of events. You remain free to prove that a lower loss was incurred.
B 7 If the operator cannot perform
(1) If the operator cannot provide your booking, it offers you an equivalent replacement car park nearby with an equivalent transfer and bears your proven additional costs resulting from this. If you do not accept the replacement, you get the full price back.
(2) Further statutory claims remain unaffected.
B 8 Liability of the operator
(1) The operator is liable without limitation for damage resulting from injury to life, body or health, for intent and gross negligence, for fraudulent concealment of defects, under the Produkthaftungsgesetz and to the extent of a guarantee given.
(2) In cases of slight negligence, the operator is liable for the breach of essential contractual obligations, in particular custody of a vehicle handed over and its key, limited to the foreseeable, typical damage. Otherwise, liability for slight negligence is excluded. Your rights to a price reduction, to withdraw and to terminate remain unaffected by this liability provision.
(3) The operator is not liable for damage caused by third parties that it could not prevent despite reasonable security, or for damage caused by force majeure, unless it is at fault.
B 9 Your liability
You are liable under the statutory provisions for damage that you or your vehicle cause on the operator's premises.
B 10 Outstanding amounts
The operator may withhold the release of the vehicle only because of due amounts under this contract that have been invoiced in a comprehensible manner, in particular for additional days and services ordered on site, and only in reasonable proportion to the value of the vehicle. If you dispute the amount, you can demand release against payment under reservation of recovery or against provision of security. Your statutory rights remain unaffected.
